1. Agreement to Terms

These Terms of Service ("Terms") govern your use of NextBite, an online ordering platform operated by NextPage IT Solutions Pvt Ltd ("Company", "we", "us", or "our"). By accessing or using our service, you agree to be bound by these Terms.

NextBite is an ordering platform that connects customers with restaurants, cafes, and food vendors ("Vendors"). We provide technology services only and are not a food service provider.

2. Service Description

NextBite provides an online platform that enables:

Vendors to display their menus and receive orders
Customers to browse menus and place orders
Communication between customers and vendors
Order management tools for vendors

3. Important Disclaimers

3.1 Food Quality and Safety

NextBite is NOT responsible for food quality, safety, hygiene, or preparation. All food-related matters are solely the responsibility of the respective vendors. We do not inspect, verify, or guarantee food safety standards or FSSAI compliance. Vendors are independently responsible for meeting all food safety regulatory requirements.

3.2 Payment Processing

NextBite does NOT process payments or act as a payment intermediary. All payments are made directly between customers and vendors. We are not responsible for payment disputes, refunds, or failed transactions.

3.3 Delivery Services

NextBite does NOT provide delivery services. Delivery is handled by vendors or third-party services chosen by vendors. We are not responsible for delivery delays, damages, or issues during transit.

3.4 Vendor Compliance & Food Safety

We are NOT responsible for ensuring vendors comply with local regulations, licensing requirements, food safety standards, or tax obligations. Each vendor operates independently and is solely responsible for:

Obtaining and maintaining valid FSSAI registration or licensing as required by law
Complying with all applicable local food safety laws and regulations
Meeting hygiene and food handling standards set by regulatory authorities
Obtaining necessary business licenses and permits

4. User Responsibilities

4.1 For Customers:

Provide accurate delivery information
Communicate directly with vendors regarding orders
Resolve payment and delivery disputes directly with vendors
Report any issues to appropriate authorities when necessary

4.2 For Vendors:

Comply with all applicable laws and regulations
Obtain and maintain valid FSSAI registration or licensing as required by applicable food safety laws
Maintain proper business licenses, permits, and certifications
Ensure food safety, hygiene, and quality standards as per regulatory requirements
Handle customer payments and refunds appropriately
Provide accurate menu information and pricing
Display FSSAI license number where legally required

Note: By using our platform, vendors confirm they will comply with applicable local food safety laws, including FSSAI registration or licensing requirements where mandated by law.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTBITE AND NEXTPAGE IT SOLUTIONS PVT LTD SHALL NOT BE LIABLE FOR:

Food poisoning, allergic reactions, or health issues from consumed food
Financial losses due to payment disputes or fraud
Delivery delays, damages, or lost orders
Vendor misconduct, illegal activities, or regulatory violations
Any indirect, incidental, special, or consequential damages
Any damages exceeding ₹1,000 or the amount paid for our services, whichever is lower

6. Pricing and Fees

NextBite charges vendors a fee of ₹2 per order after the first 30 orders per month. We reserve the right to modify pricing with 30 days notice. No refunds for service fees once orders are processed.

7. Intellectual Property

The NextBite platform, including software, design, and content, is owned by NextPage IT Solutions Pvt Ltd. Users grant us permission to use their content (menus, photos) for platform operation but retain ownership of their content.

8. Termination

We may terminate or suspend accounts at our sole discretion for violations of these terms, illegal activities, or any reason deemed necessary for platform safety and integrity.

9. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Mohali, Punjab, India.
